How to register for PPPI (Intellectual Property Program) — OLX and Mercado Livre

To submit notifications according to the guidelines of the marketplaces OLX and Mercado Livre, you need to register for the Intellectual Property Program on both platforms. This registration is necessary for us to handle incidents on these platforms.


OLX

1. Fill out the form available at this link (http://juridico.olx.com.br/formulario-sppi.pdf).

2. After completing the notification form, send it to [email protected]. The platform will review the documentation and information, and they will send you a confirmation of the registration or request additional information if something is missing.


Mercado Livre

Follow the step-by-step guide below (it's lengthy, but when you access the link, you'll see that it's straightforward to fill out):

Who can join the program?

According to the platform, “any rights holder or legal representative can join the program. Please note that the documentation required for registration may vary in each case. If the registration is done by a legal representative, a current declaration granted by the right's holder is required.”

1. Access the specific program page and click on “Quero me cadastrar” (I want to register).

2. Fill in your company's data as requested in the provided fields. We will provide screenshots for each section:

What type of user do you want to register?

Here, you need to inform the platform who wants to join the program and protect the brand's rights. You should select the option that best suits your situation. If your company is the owner of the brand, the correct option is marked in red below (“Sou titular de direitos ou representante legal” – I am a rights holder or legal representative).

  • Information about the account: In this section, you need to provide the following information about your company:

  • Name or business name: Who is the brand owner? Here, you should enter your company's name, which owns the trademark rights you want to protect in the program.

  • CPF, CNPJ, etc.: What type of identification will you provide? If you are a legal entity, fill in “CNPJ.”

  • Identification number: What is your company's document number? Enter your company's CNPJ.

  • Country: Which country do you want to protect your rights in? Enter the country related to the company and CNPJ provided in the fields above.

Example:

What types of rights do you want to register? In this area, you should inform which rights you want to protect (one or more), among the following:

  • Trademark: Which trademark do you want to protect? Remember that you must have the trademark registered in your company's name to have the legitimacy to act on its behalf. This is the most common type of registration. For example, you registered the trademark with the National Institute of Industrial Property (INPI) and it was granted to you. These are the pieces of information that will provide you with the legitimacy to make requests and join this program.

  • Industrial designs and models

  • Patents and utility models

  • Copyrights

Depending on the type of registered right, you must submit documents that prove your authorization or ownership for joining the program (suggestion: compile the necessary information in an Excel spreadsheet and also attach copies of the respective trademark registrations and other documents proving your ownership of the rights).

For each type of right, provide the following information:

  • Trademark:

    • Brand (name of the brand)

    • Country where it was granted

    • Registration number: What is the registration number in the agency of the respective country? For example, in Brazil, the agency is INPI.

    • Type of trademark: wordmark, symbolic, or combined mark

    • Logo (if it's a combined or figurative mark)

    • Waiver of exclusive rights

    • International class with coverage details: the entire class, limitation, or exclusion. Which class was the registration made in, and in which the trademark is protected? For example, NCL(9) 19 (referring to building materials (non-metallic); non-metallic rigid pipes for building; asphalt, pitch, and bitumen; non-metallic transportable buildings; non-metallic monuments).

    • Expiration date: Until when is this trademark valid and protected?

  • Industrial designs and models:

    • Designs

    • Country where it was granted

    • Registration number

    • Description

    • Expiration date

  • Patents and utility models:

    • Patent title

    • Country where it was granted

    • Registration number

    • Description of claims

    • Filing date

    • Expiration date

  • Copyrights:

Include a list of the works you want to protect and the corresponding documentation. If the right holder is an individual, attach a photo of their identification document as well.

  • Literary works: Deposits of the work before the authorities (if applicable) and any additional documentation containing the author's name, owner of the economic rights (if different), economic rights they own, publisher, title, ISBN/ISSN, countries covered by the rights, and validity of the rights.

  • Computer programs or software: Deposits of the work before the authorities (if applicable), PDF file with the list of programs or software, program or software description, and screenshots.

  • Photographs, drawings, paintings, or sculptures: PDF file containing the work, link to an official website where the pieces are displayed, and deposit of the work before the authorities (if applicable).

  • Music: Description and title of the work, deposit of the work before authorities (if applicable), and information about registration with a collective management society (if applicable).

  • Videos: Description and title of the work, screenshots.

  • Others: PDF file containing the work, link to an official website where the works are displayed, or deposit of the work before the authorities (if applicable).

Here is an example of trademark registration at INPI (we randomly selected the brand “Mavel”) and the corresponding fields to be filled in:

Based on the registration of the “Mavel” brand at INPI, the trademark information would be:

  • Brand: Mavel

  • Country where it was granted: Brazil (the country of the agency. In this example, it's INPI, which is a Brazilian agency).

  • Registration number: What is the registration number in the agency of the respective country? 903560879

  • Type of trademark: Combined

  • Logo (if it's a combined or figurative mark) – Attach the logo as proof of information

  • Waiver of exclusive rights

  • International class with coverage details: NCL(9) 19 – Building materials (non-metallic); non-metallic rigid pipes for building; asphalt, pitch, and bitumen; non-metallic transportable buildings; non-metallic monuments.

  • Expiration date: 29/07/2024

We're almost done! Now, there are only two more steps to complete the registration request for the program:

  • Representative Contact

In these fields, provide the data that Mercado Livre will use to contact your company if necessary:

  • Contact's name and surname: Who will be responsible for this account if Mercado Livre needs to get in touch with your company?

  • Corporate email: Provide an email for a contact that belongs to your company's domain (e.g., [email protected]).

  • Contact phone: Provide a phone number for contact from your company.

  • Contact language: Specify the preferred language for contact if Mercado Livre needs to get in touch with you.

  • Public data

These are the data that Mercado Livre will send to the reported seller, so they can contact you once the denunciation process is complete. Provide the brand name or the economic group name, so the seller knows who is reporting (we suggest using your company's name and email, not a specific employee's name):

Now, simply accept the terms and conditions of the program and click “Submit request” to finalize your registration.

Great! The registration request has been successfully made to Mercado Livre. Now, you should monitor your registered email inbox because Mercado Livre will contact you via the provided email to provide access information to the program or request additional information.

Once you receive the login details for the program, please forward them to us so that we can register them in our system, integrate them with the platform's API, and begin removing unauthorized listings.
