What is required to enable the execution of a takedown?
To facilitate the execution of a Takedown, it is important to provide Axur with evidence that the publication violates property rights or contains illicit content.
If the content is subject to a takedown, your company will need to provide some minimum documents for Axur to make the complaints.
They are:
Takedown Authorization Document;
Registration of your trademark or proof of identity for individuals.
What is the Takedown Authorization Document?
The Takedown Authorization Document (TAD) is a document that formalizes the relationship between the Takedown requester, who is the rights' holder (whether it be intellectual property, personality rights, etc.), and Axur. This document can be sent to hosting providers, registries, registrars, and other entities responsible for removing the content that prompted the Takedown request.
The TAD allows for the verification of the relationship between the parties without exposing unnecessary information such as the established contract, emails between Axur and the client, or service invoices. In cases of rights claims, such as trademark rights, intellectual property, or personality rights, it is necessary to prove that the claimant indeed holds the right in question. Therefore, the TAD serves as formal confirmation of the representation agreement between the client and Axur.
To request the signature of a legal representative of your brand, go to Monitoring Settings > Takedown > Takedown Authorization.
Why is the Authorization Document necessary?
The answer is simple: Legal Security.
As the platforms will perform a removal, that is, they will exclude a user/customer from their user base or published content, it is important that they are certain that there is a right being violated. So, we send the necessary documents to be able to prove, in case of a lawsuit, that the request is legitimate.
Thus, the platform has the minimum necessary information to analyze and remove fraudulent users/content.
Why should I include the brand logo in the Takedown Authorization Document?
Including the brand logo in the document is mandatory because some platforms, like Twitter/X, TikTok, and others, have started requiring this item to verify the connection with your brand. Without this item, the document and the takedown request are not reviewed by the platforms.
Does the Takedown Authorization Document have an expiration date?
Some platforms, like Twitter/X, require the Takedown Authorization Document to be less than three (3) years old to be valid. If necessary, we will contact you to request a new signature.
What is trademark registration?
It is the registration granted by the Intellectual Property Office of your country that guarantees, within its territory, the exclusive use of a name or elements that identify it.
And what can you do? Find the Intellectual Property Office of your country here to learn how to obtain the registration. After that, send the official registration of your trademark in PDF to the email [email protected] to proceed with the notification.
Why is the trademark registration document necessary?
The trademark registration is what enables the exclusive use of the brand, making it possible for us to notify fraudulent use of the brand. This document is what gives authenticity to our notifications.
What other documents can be requested?
Selfie of the Executive holding the document: for cases of privacy rights claims of executives and fake profiles on social networks. This document must be registered directly on the platform in the Monitoring Settings section. On this screen, the executive's data, a selfie holding the document, and the Authorization Term are added.
Partnership Agreement: for cases where partners cannot use the brand, and we need evidence to send to the platform or provider that that content should be removed.
Proof of fraud: when it is not explicitly clear, just by consulting the visible page.
In case of POC: when a client enters POC, it is necessary to send the responsibility letter, and a document from Axur to carry out any Takedown request.
